Welcome to Icarus Athlete. By accessing or using our website at icarusathlete.com, our mobile application, or any of our services (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our Services.

All product descriptions, pricing, and availability are subject to change without notice. We reserve the right to limit quantities, refuse orders, or cancel orders at our discretion. For custom or personalized products, you are solely responsible for the accuracy of the personalization details (name, number, design) submitted at the time of order. We are not liable for errors in personalization details provided by you.

6. Intellectual Property

All content available through our Services — including but not limited to text, graphics, logos, images, product designs, software, and audio — is the exclusive property of Icarus Athlete or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from our Services without our prior written permission.

7. User-Generated Content

If you submit reviews, feedback, photos, or other content to our Services, you grant Icarus Athlete a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, and display such content in connection with our Services and marketing activities. You represent that you own or have the necessary rights to submit such content and that it does not infringe any third-party rights.

Our Services may contain links to third-party websites or integrate with third-party services (e.g., payment processors, app stores). These links are provided for convenience only. We do not endorse or assume responsibility for the content, privacy practices, or terms of any third-party services. Your use of third-party services is governed by their respective terms and policies.

9. App Store & Mobile Application

If you access our Services through a mobile application available on the Apple App Store or Google Play Store, the following additional terms apply:

These Terms are between you and Icarus Athlete only, not with Apple Inc. or Google LLC.
Apple and Google have no obligation to provide maintenance or support for our application.
In the event of any failure of the app to conform to applicable warranties, you may notify Apple or Google, and they may refund the purchase price (if any). To the maximum extent permitted by law, Apple and Google have no other warranty obligation.
Apple and Google are not responsible for addressing any claims relating to the app or your use of it.
You must comply with applicable third-party terms when using our app (e.g., your wireless data service agreement).

10. Disclaimer of Warranties

Our Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Icarus Athlete and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from these Terms or your use of the Services shall not exceed the amount you paid to us in the 3 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Icarus Athlete and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your infringement of any third-party rights.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in India. We encourage you to contact us first to resolve any disputes amicably.

14. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
